1. UNOFEX RULES & TERMS

 

Introduction: Welcome to UNOFEX (Union of Excellence), a distinguished network and community promoting excellence and professionals, brands, and leaders across the Film & TV, Fashion, Luxury Entertainment, and Art industries. These Terms and Conditions ("Terms") govern the use of membership, listing, certification, and profile services provided by UNOFEX (Union of Excellence). By accessing or using these services, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree to these Terms, you should not access or use UNOFEX services.

 

2. MEMBERSHIP

2.1 Eligibility
To be eligible for UNOFEX membership, individuals and organizations must meet the following criteria:

Individual Members: Must be actively working in their respective industry with a minimum of three (3) years of professional experience, and have at least three (3) significant publications, distributions, or works. Optional but beneficial: Awards or nominations from national or international award shows.
Corporate and Institutional Members: Must be entities operating within the Film & TV, Fashion, Luxury Entertainment, or Art industries and demonstrate a significant contribution to the industry.

2.2 Membership Categories
UNOFEX offers the following membership categories:

a) Individual Industry Members: Recognized professionals in the creative sectors.
b) Corporate and Institutional Members: Organizations and institutions contributing to the creative industries.

2.3 Membership Benefits
Upon successful membership approval, members are entitled to:

A personalized profile crafted by UNOFEX editors.

• Inclusion in the UNOFEX curated directory.

• A feature article in the UNOFEX digital magazine.

• Certification as a UNOFEX accredited member.

• Recognition by general public, industry professionals and executives.

• Annual press release to highlight achievements.

• Opportunities for community engagement and networking.

3. MEMBERSHIP PAYMENT

3.1 Fees
Membership requires the payment of an annual fee based on the membership level selected. Additionally, a one-time initial registration fee is charged upon admission.

3.2 Payment Methods
Membership fees can be paid via:

Credit Card: Payment will be processed through a secure payment gateway.
PayPal: Payment can be made using your PayPal account.

3.3 Payment Schedule
Initial Registration Fee: Charged once at the time of membership application approval.
Annual Fee: Charged annually based on the selected membership level. The membership will be automatically renewed each year unless canceled in accordance with the cancellation policy.

3.4 Non-Payment
Failure to pay the annual fee or any other fees within the stipulated time frame may result in the suspension or termination of membership. This may include the removal of your profile from the UNOFEX directory and listing. Members are responsible for ensuring timely payment to maintain their active status.

4. LISTING

4.1 Profile Listing
Members can list their profiles on the UNOFEX platform, which includes showcasing their work, achievements, and portfolio. Profile listings are subject to review and approval by UNOFEX Chief Editor to ensure the accuracy and relevance of the content.

4.2 Accuracy and Updates
Members are responsible for ensuring that their profile information is accurate, current, and complete. Any changes or updates to profile information must be promptly communicated to UNOFEX to maintain accuracy.

5. CERTIFICATION

5.1 Certification Process
The UNOFEX certification process comprises two main stages:

Pre-Certification: Involves completing a membership application form, which will be assessed by the UNOFEX Committee Team. If the application meets the required standards, the applicant may be invited to become a Full Member. If the standards are not met, the applicant may be invited to apply as a Candidate and work towards Full Membership within three (3) years.

Full Certification: Requires the submission of a Full Accreditation Application, including a comprehensive self-review document detailing career achievements, works, biography, and awards. This application will be reviewed by an editor and a panel of assessors. In certain cases, a site audit or personal meeting may be conducted to verify the information provided.

5.2 Certification Badge
Certified members are permitted to use the UNOFEX Certification Badge in various contexts, including their CV, website, social media, media publications, and marketing materials.

5.3 Usage Rights
Certified members have the right to use the titles “Certified by UNOFEX” or “Certified by Union of Excellence” or "UNOFEX Member of the [Art, Fashion, Film, Luxury, Entertainment] Industry"  and “Certified UNOFEX Member” in all relevant communications and professional contexts.

6. CERTIFICATION STANDARDS

6.1 Standards of Excellence
To be eligible for certification, applicants must meet the UNOFEX Standards of Excellence, which include:
 

• Demonstrating significant publications or works within their field.

• At least 3 years of professional experiences within their field.

• Active participation in their professional domain.

• Optional but advantageous: Awards or notable recognition.

• Evidence of community engagement and social responsibility.
   

6.2 Evaluation Criteria
The UNOFEX Panel of Experts and Committee may also consider applicants who exhibit exceptional innovation, achievement, or potential, even if they do not fully meet the specified criteria.

7. MEMBERSHIP AND CERTIFICATION SUPPORT

7.1 Support Services
UNOFEX provides additional support beyond certification, including promotional activities, strategic development, and community engagement to enhance the visibility and opportunities for its members.

7.2 Commitment to Excellence
UNOFEX is dedicated to upholding high standards of excellence and promoting members through strategic activities that align with the best practices and benchmarks in the creative industries.

8. TERMINATION AND SUSPENSION

8.1 Termination
UNOFEX reserves the right to terminate membership or certification if a member fails to comply with these Terms, engages in conduct detrimental to the UNOFEX community, or for other reasons deemed appropriate by UNOFEX.

8.2 Suspension
Membership or certification may be suspended pending investigation into any alleged breaches of these Terms or other concerns that may affect the integrity of the UNOFEX community.

 

9. LIABILITY

 

9.1 Save in respect of death and personal injury caused by the negligence of UNOFEX or as expressly provided for in these Terms and Conditions, UNOFEX shall not be liable for any loss, cost, expense or damage of any nature whatever (whether direct or indirect) resulting from the provision of services or your reliance upon the information and suggestions provided by UNOFEX hereunder and the resulting supply of services to you by any third party

9.2 UnofEx shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect or inaccurate or any other fault of you

9.3 UnofEx shall not be liable to you or be deemed to be in breach of these Terms and Conditions by reason of any delay in performing, or any failure to perform, any of UnofEx 's obligations in relation to its services, if the delay or failure was due to any cause beyond UnofEx 's reasonable control.

9.4 Except in respect of death and personal injury and subject to the provisions of these Terms and Conditions, UnofEx's maximum liability to you for breach of any of its obligations hereunder shall be limited to the value of the annual Membership fee.

9.5 This section applies only to the extent permitted by law.

10. LINKS

 UNOFEX assumes no responsibility for the contents of any other web sites to which the Site has links and shall not be held responsible or liable for any loss or damages caused or alleged to have been caused by use of or reliance on any content, products or services available on such hyperlinked sites. UnofEx may not have control of such web sites. The inclusion of any hyperlinks to such other web sites does not mean that UNOFEX endorses the material on such web sites or has any association with the owner thereof.

11. COPYRIGHT AND PLAGIARISM

UNOFEX owns or is lawfully entitled to all of the copyright in this Site. All other intellectual property rights are reserved. This Site is for your personal use only - you may not use it for commercial purposes. You may only download to your personal computer for viewing purposes and print out a number of pages of this Site for your personal use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this Site. This applies to UNOFEX members, all non-members, including anyone who visits this Site.

12. AMENDMENTS

UNOFEX reserves the right to amend these Terms at any time. Members will be notified of significant changes, and continued use of UNOFEX services will constitute acceptance of the updated Terms. Notification will be by some or all of the following medium:
a) The UNOFEX Newsletter
b) The UNOFEX Website
c) Email
d) The post or other personal delivery service

13. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the USA (UNOFEX LLC and UNOFEX AG Switzerland Europe. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Zurich, Switzerland or New York City, USA.
